Terms of Service & End User License Agreement

Welcome to Keepsule. These Terms of Service and End User License Agreement ("Terms" or "EULA") govern your use of the Keepsule application ("App") and related services provided by Abdoul Aziz Paye ("we", "us", "our"). By creating an account or using Keepsule, you agree to be bound by these Terms. If you do not agree, do not use the service.

1. Acceptance of Terms

By downloading, installing, or using Keepsule, you acknowledge that you have read, understood, and agree to these Terms. These Terms constitute a legally binding agreement between you and the developer. Your continued use of the App constitutes acceptance of any updates to these Terms.

2. Description of Service

Keepsule is a digital time capsule application that allows users to create, seal, and unlock capsules containing text, images, and other media. Capsules can be set to unlock at a future date. The App includes public and social features such as Explore (public capsule feed), Spaces (group capsule sharing), comments, and likes.

3. Eligibility & Account Responsibilities

• You must be at least 13 years old to use Keepsule. If you are under 18, you must have parental or guardian consent.
• You are responsible for maintaining the security and confidentiality of your account credentials.
• You must provide accurate, current, and complete information when creating your account.
• You are responsible for all activity that occurs under your account.
• You may not create multiple accounts to circumvent bans, blocks, or content limits.
• Account recovery: If you lose access to the email address associated with your account, we may be unable to recover your account or its contents. You are solely responsible for maintaining access to your sign-in credentials and any backup recovery methods provided by the App.

4. User-Generated Content & Community Standards

Keepsule allows users to create and share content. You retain ownership of all content you create. By making a capsule public or posting to a Space, you grant Keepsule a non-exclusive, worldwide, royalty-free license to display that content to other users within the App for the purpose of operating the service.

Zero Tolerance Policy: Keepsule has zero tolerance for objectionable content or abusive behavior. You agree not to post, share, or transmit any content that is:

• Illegal, harmful, threatening, or inciting violence
• Harassing, bullying, intimidating, or abusive toward any individual or group
• Hateful, discriminatory, or promoting prejudice based on race, ethnicity, gender, sexual orientation, religion, disability, or any other protected characteristic
• Sexually explicit, pornographic, or depicting sexual exploitation of minors
• Promoting self-harm, suicide, or dangerous activities
• Spam, misleading, deceptive, or fraudulent
• Infringing on intellectual property, copyrights, trademarks, or privacy rights of others
• Containing malware, viruses, or malicious code
• Impersonating another person or entity
• Violating any applicable local, state, national, or international law

We reserve the right to determine, in our sole discretion, what constitutes objectionable content. Content that violates these standards will be removed, and the user responsible may be permanently banned from the platform.

5. Reporting, Blocking & Content Moderation

Keepsule provides tools to help keep the community safe:

• Reporting: You can report any public capsule, Space, or user content that you believe violates these Terms. Reports include the reason, an optional note, and a snapshot of the content for review.
• Blocking: You can block any user at any time. Blocking immediately hides all content from that user in your feed. You can manage blocked users in Settings > Privacy & Security > Blocked Users.
• Moderation: We aim to review reports within 72 hours. Actions may include content removal, account warnings, temporary suspension, or permanent account termination depending on the severity of the violation. Severe violations (including threats of violence and child exploitation) are prioritized for immediate review.
• Automatic enforcement: Content that receives multiple reports in a short period may be automatically hidden from public feeds pending manual review.
• Appeals: If you believe your content was removed in error, you may contact us at keepsuleapp@gmail.com to request a review.

Consequences for violations:

• First offense: Content removal and written warning
• Second offense: Content removal and temporary account suspension (7 days)
• Third offense or severe violation: Permanent account termination with no right to create a new account
• Severe violations (threats of violence, child exploitation, illegal activity) may result in immediate permanent ban and referral to law enforcement

6. The Seal

When you seal a capsule with an unlock date, the capsule becomes locked and cannot be opened early. This is by design. By sealing a capsule, you acknowledge and accept that you will not be able to access its contents until the unlock date. Keepsule is not responsible for any inconvenience caused by sealed capsules.

7. Capsule Sharing

You may share capsules with other users by generating a temporary share link. By sharing a capsule, you acknowledge that:

• The recipient will see your display name, profile photo, and capsule metadata (title, type, cover image, lock status)
• The share preview does not include the capsule body text
• Share links expire automatically after 10 minutes and cannot be extended
• You can revoke a share link at any time before it is accepted
• Once accepted, a snapshot of the capsule may be stored in the recipient's account so they can view or save it in Keepsule, depending on the capsule's visibility and unlock state
• You are responsible for who you share links with — anyone with an active link can accept it

Keepsule is not responsible for content shared via share links after they leave the App.

8. Keepsule Plus (Auto-Renewable Subscription)

Keepsule Plus is an optional auto-renewable subscription that provides additional features including increased weekly capsule limits, Gallery capsule type, and custom event unlocks.

• Pricing: $4.99/month or $39.99/year (USD). Prices may vary by region and are displayed in your local currency at the time of purchase.
• Billing: Payment is charged to your Apple ID account at confirmation of purchase. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
• Renewal: Your account will be charged for renewal within 24 hours prior to the end of the current period at the same price.
• Management & Cancellation: You can manage or cancel your subscription at any time through your device's Settings > Apple ID > Subscriptions. Cancellation takes effect at the end of the current billing period — you retain access to Plus features until then.
• Refunds: Refund requests are handled by Apple in accordance with their refund policies. Keepsule does not process payments or issue refunds directly.
• Free tier: You can use Keepsule without a subscription. The free tier currently includes 3 capsules per week and access to Letter, Diary, Goals, Reflection, and Event capsule types.
• Changes to Free Tier or Pricing: We reserve the right to modify free tier limits, features, capsule types, subscription pricing, or availability at any time. For material reductions to free-tier functionality or subscription price increases affecting existing paid subscribers, we will provide at least 30 days' notice through the App or by email before the change takes effect.

9. Intellectual Property

The Keepsule App, including its design, code, logos, trademarks, and documentation, is the intellectual property of Abdoul Aziz Paye and is protected by copyright and trademark laws. You may not copy, modify, distribute, sell, or lease any part of the App without written permission.

10. Copyright & DMCA

We respect the intellectual property rights of others. If you believe content on Keepsule infringes your copyright, please contact us at keepsuleapp@gmail.com with:

• A description of the copyrighted work you claim has been infringed
• The location of the infringing content within the App
• Your contact information
• A statement that you have a good faith belief that the use is not authorized
• A statement, under penalty of perjury, that the information is accurate and you are authorized to act on behalf of the copyright owner

We will respond to valid copyright claims promptly and may remove or disable access to the infringing content.

11. Privacy

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your data. By using Keepsule, you consent to the data practices described in the Privacy Policy.

12. Service Availability & Force Majeure

We strive to keep Keepsule available at all times, but we do not guarantee uninterrupted service. We may perform maintenance, updates, or changes that temporarily affect availability. We are not liable for any loss resulting from service interruptions.

Force Majeure: We are not liable for any failure, delay, interruption, or data loss caused by events beyond our reasonable control, including but not limited to cloud infrastructure or third-party service outages (such as Google Cloud, Firebase, or Apple services), natural disasters, pandemics, cyber attacks, denial-of-service attacks, acts of war or terrorism, labor disputes, internet failures, power outages, or government actions. In the event of such circumstances, our obligations under these Terms are suspended for the duration of the event.

13. Disclaimer of Warranties

Keepsule is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.

Content Preservation & Backups: While we use industry-standard cloud infrastructure to store your capsule content, we do not guarantee the preservation of your content for any specific duration. You are solely responsible for maintaining your own backups of any capsule content that is important to you. We are not liable for any loss, corruption, or unavailability of capsule content or other user data, including but not limited to loss resulting from: account deletion (yours or ours), technical failures, third-party service outages, security incidents, service discontinuation, migration, or any cause whatsoever. Do not rely on Keepsule as the sole or permanent repository of irreplaceable content.

14. Limitation of Liability

To the maximum extent permitted by law, Keepsule and its developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, profits, or goodwill, arising from your use of or inability to use the service. Our total liability shall not exceed the amount you paid for the service in the 12 months preceding the claim.

15. Indemnification

You agree to indemnify, defend, and hold harmless Keepsule and its developer from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the App, your content, your violation of these Terms, or your violation of any rights of another user or third party.

16. Termination

You may delete your account at any time through the App settings. We may terminate or suspend your account immediately, without prior notice, if you violate these Terms or engage in conduct that we determine is harmful to other users, us, or third parties. Upon termination, your data will be deleted in accordance with our Privacy Policy.

17. Governing Law, Disputes & Class Action Waiver

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of Maryland, without regard to conflict of law provisions. Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction, and either party may bring an individual claim in small claims court for disputes within its jurisdictional limits.

Class Action Waiver: You and Keepsule agree that any dispute shall be resolved on an individual basis only. You expressly waive any right to participate in a class action, class arbitration, collective action, private attorney general action, or any other representative proceeding. The arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of representative or class proceeding. If this class action waiver is found to be unenforceable in a particular case, then the entirety of this Section 17 shall be null and void as to that case, and the dispute shall proceed in a court of competent jurisdiction in Maryland.

Time Limit: Any claim arising out of or related to these Terms or the App must be brought within one (1) year after the cause of action arose, or it is permanently barred.

18. Apple-Specific Terms

If you access Keepsule through the Apple App Store, the following additional terms apply:

• This EULA is between you and Abdoul Aziz Paye, not Apple. Apple is not responsible for the App or its content.
• Apple has no obligation to provide maintenance or support for the App.
• In the event of any failure of the App to conform to applicable warranties, you may notify Apple for a refund of the purchase price (if any). Apple has no other warranty obligation with respect to the App.
• Apple is not responsible for addressing any claims relating to the App, including product liability, legal compliance, or intellectual property infringement.
• Apple and its subsidiaries are third-party beneficiaries of this EULA and may enforce it against you.

19. Changes to Terms

We may update these Terms from time to time. When we make material changes, we will notify you through the App or by email. Continued use of Keepsule after changes constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the App and delete your account.

20. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
